Project Description:

The Department has prepared a draft permit and fact sheet and has made a tentative determination to modify the Village Wastewater Treatment Plant's SPDES Permit (#NY 0023574) to increase summer flow limits to 1.3 million gallons per day and winter flow limits to 1.9 million gallons per day of treated discharge to Great Valley Creek, which has a classification of C and standard of C(T). Quarterly whole effluent toxicity testing will be required for the first and fifth years of the permit. In addition, ultimate oxygen demand limits will be imposed as replacement for the current biochemical oxygen demand, 5 day limits. Other requirements include an in-stream monitoring schedule and a mercury minimization program. The facility is located east of Wildflower Street, between US Route 219 and County Highway 71.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 24, 2014.

Project Description:

The Department has prepared a draft permit and made a tentative determination to approve a modification to the SPDES wastewater discharge permit (NY0258636) for the plant on Staley Road. The proposed modification would reduce the bis-(2-Ethylhexyl) Phthalate limit from 35 to 30 μg/l and update the water treatment chemicals list. The facility is permitted to discharge a daily maximum up to 240,000 gallons per day of treated process wastewater to a Class D unnamed tributary of Big Six Mile Creek. The Department has made a tentative determination to approve this modification. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
