Project Description:

East Martinsburg Pit (VS Virkler & Sons LLC): The Department has received an application for the modification/renewal of a pre-existing State Facility Permit. The application seeks authorization to operate air pollution sources and has drafted - pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit for the facility to be located at "East Martinsburg Pit", in the Town of Martinsburg, in Lewis County, in the State of New York. The exact location will be on Whittaker Road, 1000 feet west of State Route 12. For the purposes of this permit, this facility is engaged in the the crushing, screening and conveying of limestone. The Standard Industrial Classifications representative of this facility is 1422 (Crushed and Broken Limestone). The main source of air emissions originates from both limestone dust and also from diesel exhaust. With respect to air pollution regulation, the emissions of concern at The East Martinsburg Pit are particulate matter, carbon monoxide and the oxides of nitrogen. The facility has elected to cap NOx emissions at 80 tons per year, the intent being to avoid a Title V Permit and to comply with NOx RACT.

This draft permit with all conditions is available for public review at the Region 6 NYSDEC sub-office in Utica, NY.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Mohawk Valley Water Authority (MVWA) submitted a Water Withdrawal application requesting the modification of their existing Water Supply Permit #9435. The request is to increase MVWA's authorized service area to include the Towns of Frankfort and Schuyler in Herkimer County, and the Towns of Kirkland and Westmoreland in Oneida County. The proposal will expand the authorized service area by more than 50% and is classified under Uniform Procedures Act as a Major Project. The modification will also include a maximum taking of up to 32 million gallons per day from Hinckley Reservoir with approximately 3 million gallons per day reserved for possible future use by the remaining communities located within the West Canada Creek drainage basin below Hinckley Reservoir. Although MVWA has recently reached agreement with the New York State Canal Corporation regarding rights to additional amounts of water above 32 mgd (50 cfs), 32 mgd is the current capacity of MVWA's water treatment plant and it's estimated water need projecting out to year 2050. MVWA is not proposing to build any new water treatment facilities or infrastructure in the four towns at this time; it is seeking pre-approval to serve these areas should future development projects be proposed.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
