Pursuant to Environmental Conservation Law (ECL) Sections 1-0101, 1-0303, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105; the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:
Notice of adoption of rules on November 27, 2013, to be effective January 1, 2014, to revise 6 NYCRR Part 242, "CO2 Budget Trading Program" and 6 NYCRR Part 200, "General Provisions."
The adoption of Part 242 is intended to implement the updated Regional Greenhouse Gas Initiative Program in New York State.

Notice of Availability of Final Retrofit Program Plan Guidance Document for Pathogen Impaired Watershed MS4s on Long Island
The New York State Department of Environmental Conservation (NYS DEC) has finalized the "Retrofit Program Plan Guidance Document for Pathogen Impaired Watershed MS4s on Long Island". The guidance clarifies what NYS DEC expects should be submitted by MS4 Operator's to meet the permit requirements for retrofit plan submission in Watershed Improvement Strategy Areas as specified in Part IX.C of the SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems (GP-0-10-002).

Notice of Availability for Comment - Renewal of State Pollutant Discharge Elimination System (SPDES) Concentrated Animal Feeding Operations (CAFO) General Permit
The New York State Department of Environmental Conservation (NYS DEC) proposes to issue a renewal of SPDES CAFO General Permit GP-0-09-001. Upon issuance, this general permit will be an interim general permit, replacing the expiring permit, GP-0-09-001, which became effective on July 1, 2009, was modified on July 29, 2013 and expires on June 30, 2014. NYS DEC elects to issue an interim general permit, with no changes, in order to devote sufficient time to work with a diverse stakeholder group to consider potential future changes to the ECL CAFO general permit. The general permit (GP-0-14-001) will be effective on July 1, 2014 for a limited time period. The interim general permit will authorize the operation and construction of a CAFO that is defined in the New York Environmental Conservation Law (ECL) §17-0105 (16), Title 6 of the Codes, Rules and Regulations of the State of New York (6 NYCRR), Part 750-1.2(a) and Appendix A of GP-0-14-001. Owners or operators of existing CAFOs with coverage under GP-0-09-001 shall be covered by the interim general permit. State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.

Final Amendment No. 1 to the Drinking Water State Revolving Fund Federal Fiscal Year (FFY) 2014 Intended Use Plan
FFY 2014 Readiness List Project Amendment:
Draft Amendment #1 to the Drinking Water State Revolving Fund Intended Use Plan issued October 1, 2013 was published in the November 27, 2013 issue of the Environmental Notice Bulletin. The comment period for the Draft Amendment #1 closed on December 11, 2013. The New York State Department of Health (NYS DOH)received no public comments pertaining to this amendment. Therefore, the amendment to the Drinking Water State Revolving Fund Intended Use Plan is final as shown below:
Cayuga (V), Cayuga County DWSRF#16114 - The project borrower field is amended to add the Town of Aurelius as a borrower as this is a joint project between the two municipalities. The project cost is amended from $6,875,100 to $8,315,000 based on updated costs that have been developed since the project was initially listed in 1997. The breakdown of the costs (subject to adjustment if needed) for the two borrowers is: $2,927,500 (DWSRF#16114A) for the Village of Cayuga and $5,387,500 (DWSRF#16114B) for the Town of Aurelius.
NYS DOH has determined that the project amendment is necessary, reasonable, and in the interest of protecting public health. The project amendment will not adversely affect any project on the Intended Use Plan Project Annual List above the subsidized funding line. Except for the above noted change, there are no other changes to projects listed on the Project Annual List or to the Intended Use Plan as a result of this amendment.

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control
Final FFY 2014 Intended Use Plan (IUP) and
Final Amendment No. 2 to the FFY 2013 CWSRF Intended Use Plan
The New York State Environmental Facilities Corporation (NYS EFC) and the New York State Department of Environmental Conservation (NYS DEC) have prepared the final Federal Fiscal Year (FFY) 2014 Intended Use Plan (IUP) for the Clean Water State Revolving Fund (CWSRF). The IUP includes a list of projects that may receive financial assistance between October 1, 2013 and September 30, 2014.
The final 2014 CWSRF IUP is available to review and download at NYS EFC's website at: www.efc.ny.gov (Click on "Clean Water State Revolving Fund", then "Intended Use Plan and Amendments").
In addition, NYS EFC and NYS DEC announce that Final Amendment No. 2 to the FFY 2013 CWSRF is adopted. This amendment to the FFY 2013 CWSRF IUP presents guidance related to the implementation of the Storm Mitigation Loan Program (SMLP). Additionally, the amendment includes the following changes: A text change to the final IUP, a statement of the final FFY 2013 USEPA Capitalization Grant amount and a statement of availability of a fifth round of Green Innovation Grant Program funding.
