Former Hampshire Chemical Corp. - Cayuga-Seneca Canal Sediment Removal in Waterloo, New York

Public Availability Session and Public Meeting: The New York State Department of Environmental Conservation (NYS DEC) will be holding a public availability session and a public meeting regarding NYS DEC's proposed cleanup alternatives for the remediation of the Cayuga-Seneca Canal off-site of the Former Hampshire Chemical Corp. in Waterloo, New York. This proposal is discussed in detail in NYS DEC's draft Statement of Basis (SB). This session and public meeting will be held according to the following schedule.

The public availability session will be informal, where members of the public can ask questions of NYS DEC's staff on a one-on-one basis regarding the content of the draft SB. The public meeting will consist of a presentation summarizing the proposed corrective measure followed by a question and answer period, during which verbal or written comments may be submitted on the SB.

Written Comment Period: NYS DEC has also instituted the time period it will accept written comments from the public on the proposed remedy. Comments must be submitted no later than Thursday, January 16, 2014. Notice of Draft Environmental Impact Statement Acceptance, Complete Application, and Notice of Public Hearing

This notice is issued pursuant to 6 NYCRR Parts 617 and 621 of the implementing regulations pertaining to Article 8 (State Environmental Quality Review Act; SEQR), Article 70 (New York State Uniform Procedures Act; UPA) and Article 23, Title 27 (Mined Land Reclamation Law) of the Environmental Conservation Law.

The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has accepted a Draft Environmental Impact Statement (Draft EIS) for the proposed action described below. In addition, NYS DEC has determined that a legislative public hearing will be held on January 7, 2014 to accept unsworn, oral written comments on the Draft EIS and the complete applications described below. In the event the January 7, 2014 public hearing is postponed due to inclement weather, the alternate public hearing date is January 8, 2014. Written comments on the Draft EIS and permit applications will be accepted by NYS DEC until January 24, 2014.

This document constitutes the NYS DEC Notice of Complete Application for a modification to the existing mined land reclamation permit for the applicant's facility listed below. NYS DEC staff have determined that the applicant's Mined Land Use Plan is complete for the purpose of public review and comment, and for technical review by NYS DEC Mineral Resources staff.

Location: The project site is located on the south side of NYS Route 5 at River Road in the Town of Caledonia, Livingston County.

Description of Action: The applicant, Valley Sand & Gravel, Inc, is proposing to add approximately 103 acres to the existing life of mine. The proposed area would be mined in four (4) phases over a projected 30-year period. The mined sand and gravel would be transported to the current plant and stockpile location by truck initially, until a pit is established, thence a field conveyor would be utilized under River Road to convey the material from the proposed site to the existing pit. Processing will include screening, crushing and washing. The site will be reclaimed to open space by grading, replacement of topsoil, and re-vegetating upland areas along with the creation of a 3.4 acre pond.

Draft EIS Acceptance: NYS DEC, as lead agency, issued a Positive Declaration of environmental significance on September 5, 2008, held a public scoping on October 8, 2010, and issued the Draft EIS Final Scoping Outline on July 6, 2008. A Draft Environmental Impact Statement was initially submitted on December 8, 2010 and, after review of subsequent revisions, accepted by the NYS DEC on December 5, 2013. The Draft EIS discusses the existing conditions and potential environmental impacts of the mine on land use, ground and surface waters, wetlands, noise, dust, traffic, wildlife and historic resources. The Draft EIS has been accepted by NYS DEC as sufficiently adequate in format and content to be accepted for public review and comment.

Public Hearing: A legislative public hearing, pursuant to 6 NYCRR Part 617 and Part 621, will be held on January 7, 2014 at 7:00 p.m. to hear unsworn, oral comments on the Draft EIS and the Article 23 Mined Land Reclamation permit application. In the event the January 7th public hearing is postponed due to inclement weather the alternate public hearing date is January 8, 2013 at 7:00 p.m. The hearing will be held at the Caledonia Town Hall, located at 3109 Main Street, Caledonia, NY.

All persons, organizations, corporations or government agencies that may be affected by the project are invited to attend the legislative hearing session. It is not necessary to file a written request in advance to speak at the legislative hearing. Lengthy statements should be in writing and summarized for oral presentation. Reasonable time limits may be set for each speaker to afford everyone the opportunity to be heard. Equal weight will be given to both oral and written statements. The hearing location is reasonably accessible to persons with a mobility impairment. Pursuant to the State Administrative Procedures Act (SAPA), interpreter services shall be made available to hearing impaired persons, at no charge, upon written request to NYS DEC's contact person at the address below. Requests for interpreter services shall be made at least 7 business days in advance of the hearing date.

Public Comments: Written public comments on the Draft EIS and Article 23 (Mined Land Reclamation) permit application will be accepted by NYS DEC until January 24, 2014.
