Project Description:

The Department has made a tentative determination to renew and modify the Air State Facility Permit for the cogeneration facility which heats and supplies power to many of the buildings at Monroe Community College, to authorize the installation of oxidation catalysts (control devices) on the natural gas fired engines to meet the National Emission Standards for Hazardous Air Pollutants for Stationary Internal Combustion Engines (NESHAPS). In accordance with the revised air regulations (6 NYCRR 201.5), the permit will be renewed and given an expiration date of 10 years. The Department proposes to eliminate the carbon monoxide (CO) emissions cap (less than 100 tons per year), to cap out of Part 201.6 (Title V), which included restrictions on operating hours, from the permit because the potential to emit will be lower than Title V thresholds due to the control of CO by the proposed catalysts.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Article 23 Title 27 Mined Land Reclamation

Project Description:

The Department has received a Mined Land Reclamation application from Montemorano Bros Inc for the expansion of the mine site known as Pit # 5. The applicant proposes to expand an existing 39 acre sand and gravel mine by 56.5 acres, to a total of 95.5 acres within properties totaling 363.84 acres. The proposed expansion area consists of an open agricultural field to be added to the south end of the current Life of Mine (LOM) area. It is on the east side of High Street, approximately 1250 feet south of County Route 247 (Travel Knapps Corners Road) in the Town of Galen.

Operation of the mine into the expansion area will continue surface extraction of sand and gravel from above and below the local water table, south of the previously approved excavation area, enlarging the existing pond on the mine site. Excavation will be by bulldozer, front end loader, hydraulic excavator, and cable crane dragline.

Mining operations will remove approximately 1,900,000 cubic yards of additional material from the expansion area. Currently permitted material processing - crushing, screening and washing - will continue.

Final reclamation will convert the expansion area to mostly open water, with vegetated open grassland adjacent to the excavated pond. Reclamation will include the replacement of stockpiled topsoil and re‑seeding of the area adjacent to the pond.

Hours of operation will be Monday through Friday from 6:30 AM to 6:30 PM, and Saturdays from 7 AM to 5 PM with no mining Sundays and holidays. No change in truck traffic volume is proposed.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Galen and the Village of Clyde.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
