Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification to the facility's Title V Air Facility Permit to expand the capabilities at the Terminal to include the storage of heated petroleum products, including crude oil and biofuels. The heated petroleum products will be subject to the existing throughput caps in the Title V Permit; as a result, no increase to the Terminal's existing throughput caps are being requested. The products require heating to be pumped and will be heated to varying temperatures based on the viscosity of the product. The emissions from the heated petroleum products are lower than the emissions from the crude oil that is currently permitted for storage at the facility; therefore the facility's potential to emit (PTE) will not change as a result of this modification.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The Department has made a tentative determination to approve the re-issuance of a State Pollutant Discharge Elimination System Permit under Article 17 of the Environmental Conservation Law for an existing non-contact cooling water surface discharge to an unnamed tributary of the Roeliff Jansen Kill and a 500 gpd maximum treated sanitary wastewater discharge to groundwater. The facility is an organic produce storage and distribution operation. This tentative determination indicates that the discharges regulated under this statute satisfies regulatory standards for permit issuance, based on information available to the Department at this time. The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

Project Description:

The applicant proposes to use timber mats within Freshwater Wetland H-24 to facilitate a selective timber harvesting project. The timber mats will be used for a log landing (stockpile) area off Buntline Drive and a timber bridge, culvert, or corduroy crossing will be used within a water crossing area on the existing haul road. Project will be conducted during winter months when ground is frozen. The site is located on Buntline Drive off County Route 18 within the Village of Stamford.
