A new permit for Montclair Townhouse Condominiums has been drafted updating the previously expired permit. The previous permit was incorrectly classified as a Class 02, State Non-significant Minor (Private/Commercial/Institutional) facility instead of a Class 09, State Significant Minor facility. The wastewater treatment plant uses extended aeration system and is permitted to discharge 78,000 gpd of treated sanitary wastewater to the Subtrib. of Wappinger Creek, a Class C waterbody. In response to the Department's March 9, 2011 Notice of Violation, Montclair Townhouse Condominiums submitted a SPDES Permit application packet on August 2, 2011. Based upon the review of the application, a new SPDES permit has been drafted. The facility is reclassified as Significant Minor P/C/I Facility, Discharge Class 09. The submission of a monthly Discharge Monitoring Reports (DMR) is required.

Project Description:

The Town of Montgomery proposes construction of a 750 square foot municipal sewage pump station on the north shoulder of Orange Co. Route 199 (a.k.a Neeleytown Road) 2150 feet west of the Beaverdam Road intersection, near Beaverdam Brook (NYS ID# H-89-20-6, Class A) and including a portion of the regulated adjacent area of NYS Freshwater wetland MB-1 (Class 2), in order to increase the existing sewage conveyance system capacity and reduce future risk of sanitary sewage overflows upstream. No disturbance will occur to the bed or banks of Beaverdam Brook. The pump station will be constructed by United Natural Foods, Inc. (UNFI) during their current construction project on the same site and then dedicated to the town for operation and maintenance, as part of the Industrial Development Agency Agreement between the two parties. Any excavated material will be used on-site outside of the wetland and its adjacent area, and standard erosion and sediment controls will be utilized.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal to an existing Title V permit for Continental Buchanan LLC, formerly known as Lafarge North America at Buchanan. This renewal includes minor administrative changes.

The facility produces bulk gypsum and wallboard. Gypsum rock is delivered to the facility by water borne vessel. Raw, reclaimed gypsum material and synthetic gypsum material can be stockpiled or sent directly to processing.

The first step in the process is the crushing of the raw, reclaimed gypsum material and synthetic gypsum to reduce the maximum rock size. The material then proceeds to the calcining mill, where the free and chemically-bound water is removed.

The product of the calcining mill, called stucco, is then pneumatically conveyed to the wallboard plant. Here the stucco is conveyed to the pin mixer. Depending upon the type of wallboard being produced, appropriate additives, including water, are mixed with the stucco in the pin mixer to produce slurry. The slurry is extruded between two sheets of paper on the forming line. While traveling down the length of the forming line, the slurry hardens into wet wallboard. At the end of the forming, the wet wallboard is cut into varying lengths and is inverted to protect the face of the board during drying.

Finally, the boards are conveyed through the board dryer to drive off moisture and induce chemical bonding of the wallboard ingredients. The wallboard is finished with end saws and the exposed ends are sealed with tape. The wallboard is then stored until shipment off site.

Applicable regulations include 6NYCRR Part 200, 201, 202, 211, 212, 215, 227, 40 CFR 60-OOO, 65-UUU, 64, 68, 82-F.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
