Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 2 for a maintenance and repair facility for subway cars. The facility operates three stationary combustion boilers each rated at 24.5 mm btu/hr and a portable boiler rated at 32.7 mm btu/hr which is to be removed in November of 2013; also contains a subway paint booth using a water curtain and dry filter for particulate control; a car component using a dry filter for particulate control, an electric motor repair shop coating operations, two tanks for manual dip coating of parts plus exempt sources. The facility is subject to the provisions of Title V and 6 NYCRR Parts 226, 228, 227-2 and 40 CFR 60 Subpart Dc for the new boilers. The facility is proposing a NOx emission cap of 24.5 tons per year on emission unit 2-00BLR and will be in compliance with all applicable state and federal regulations such as New Source Review.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The Department has made a tentative determination to approve an application for an existing facility, a 1,844 unit cooperative apartment complex, with an integral total energy plant. The modification involves removal of three existing engines and construction of three new engines. Per Subpart 201-6.2, the owner shall modify the existing Title V permit to include the new engines. Oxides of nitrogen emissions from the new engines under this permit are capped to 25 tons per year on a rolling monthly basis.

The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice.

Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.
