Project Description:

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification to the State Pollutant Discharge Elimination System (SPDES) Permit NY0022357, pursuant to 6 NYCRR Part 750-1.18. The DEC has adopted the Phase II Watershed Implementation Plan for New York Susquehanna and Chemung River Basins and Chesapeake Bay Total Maximum Daily Load (Phase II WIP to satisfy the requirements for meeting the nutrient and sediment loads outlined in the Chesapeake Bay Total Maximum Daily Load (TMDL) developed by the U.S. Environmental Protection Agency (EPA). EPA's objective is for watershed jurisdictions to implement the actions necessary to achieve the nutrient and sediment allocations by 2025 and to have controls in place by 2017 that will achieve 60% of the necessary reductions from 2009 loads. This permit includes Water Quality Based Effluent Limits for Total Phosphorus 12 month load and Total Nitrogen 12 month load based upon the 2017 Interim Waste Load Allocations in the TMDL. This permit also includes monitoring requirements for Total Phosphorus, Total Nitrogen, Nitrate, Nitrite, and Total Kjeldahl Nitrogen (TKN), as well as footnotes regarding the implementation schedule and limit calculations for the Total Phosphorus 12 month load and Total Nitrogen 12 month load limits. The final Water Quality Based Effluent Limits for these parameters, based on the Waste Load Allocations in the TMDL, shall become effective January 1, 2025. This permit also includes a phased aggregate limit for total nitrogen delivered to the Chesapeake Bay on a rolling annual total basis from all significant permits located within the Chesapeake Bay watershed, as described in the Fact Sheet and in accordance with the Phase II WIP.

As part of this modification, the General Permit Requirements section has been updated in accordance with DEC and EPA agreement and the Recording, Reporting and Additional Permit Requirements have been updated in accordance with State and Federal Regulations.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes a 3.2 acres expansion of the previously permitted 5.9 acre Beckerink Gravel Pit to provide gravel and fill for local projects in the area.
