The Department has prepared a draft permit and has made a tentative determination to issue a modification Title V Air Facility Permit for the Boiler 2 tube repair/replacement scope which consists of replacing the elements that have been removed from the boiler and those remaining elements that have been damaged with replacement elements matching the original Boiler design. The project is subject to the recordkeeping and reporting requirements of 6NYCRR Part 231-11.2.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

This permit proposes to stabilize eroded stream sections of Stony Clove Brook, WI # H-171-45, a Class B (TS) stream, and a portion of Warner Brook, W I # H-171-42-2, a Class C (TS) waterbody. The purpose of this project is to stabilize the Stony Clove Creek channel and banks for a distance of about 400 feet beginning approximately 400 feet upstream of the Silver Hollow Road Bridge in the Town of Shandaken in order to protect Silver Hollow Road and State Route 214. The work would include the installation of four grade control structures across the channel bed that consist of buried sheet piling, large boulders and cobble (stream material) fill. These grade control structures will prevent the channel bed from downcutting (dropping) and provide a stable base for the streambank repair work along Silver Hollow Road. This repair work will consist of grading of the bank to a stable slope and installing a dumped rock riprap armoring on the bank. Approximately 6000 cy of material will be removed from Warner Creek, and approximately 4000 cy will be used for fill in the Stony Clove.
