Public Notice

Public Meeting and Extension of the Comment Period

This notice announces a public meeting and extension of the comment period for the previously released Draft Total Maximum Daily Load (TMDL) document proposed by New York State Department of Environmental Conservation (NYS DEC) to address the following waterbodies:

Black Creek, Upper, Genesee County
Bigelow Creek, Genesee County

A public meeting will be held on October 30, 2013 at 1:00 p.m. to discuss the draft TMDL at the Genesee County Park Interpretive Nature Center located at 11095 Bethany Center Road, East Bethany, NY 14054. Information on the location is available at: http://www.co.genesee.ny.us/departments/parks/inc.html.

NYS DEC is extending the public comment period on the draft TMDL and will now accept comments until the close of business on November 15, 2013.

Negative Declaration

Livingston County - The Town of Livonia, as lead agency, has determined that the proposed Conesus Streambank Remediation Project will not have a significant adverse environmental impact. The action involves a proposal by the Town of Livonia, in partnership with Livingston County, the Town of Conesus, the Town of Geneseo, and the Village of Livonia, for the design, permitting, and construction of sustainable, long-term restoration/remediation measures along multiple priority stream reaches occupying portions of five tributary streams draining to Conesus Lake: Wilkins Creek, Densmore Creek, North Gully Stream, North Macmillan Creek, and Long Point Creek. Funding is being provided through the New York State Department of State Environmental Protection Fund Local Waterfront Revitalization Program Grant with a 50% local match provided by the project sponsor and partners. This is a two-phased project, with restoration/remediation in reaches of Wilkins Creek, Densmore Creek, North Gully Stream and North Macmillan Creek in the first phase and restoration/ remediation in reaches of Wilkins and Long Point Creeks in the second phase. Proposed activities include (but are not limited to) restoration/establishment of stable stream channel cross-section and profile; disconnection of the thalweg from existing erosional areas; remediation of actively eroding banks, including grading and vegetation to reduce bank height and angle; reconnection of floodplain; removal of invasive vegetation; native riparian buffer establishment and protection; installation of features such as rock cross vanes, log deflectors, root wads, mud sills, and rock or bioengineered toe protection to reduce erosion, provide thalweg and grade control, maintain stable feature (riffle and pool) spacing, and improve instream habitat; and realignment of portions of the channel(s) to reduce tortuous meander. The project is located along segments of Wilkins Creek, Densmore Creek, and North Gully Stream all in Town of Livonia, New York (with Wilkins Creek also in Village of Livonia); North Macmillan Creek in the Town of Conesus, New York; and Long Point Creek in the Town of Geneseo, New York. All are tributaries to Conesus Lake in Livingston County.
