Notice of Adoption to Amend 6 NYCRR Section 40.1

Pursuant to the Environmental Conservation Law sections 11-0303, 11-1303, 13-0105 and 13-0342, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Notice of Adoption to amend 6 NYCRR Section 40.1 pertaining to Atlantic menhaden regulations. This rule making will establish Atlantic menhaden commercial quota management, reporting requirements and a recreational possession limit. This rule making is necessary to implement Amendment 2 of the Atlantic States Marine Fisheries Commission (ASMFC) Atlantic menhaden Fishery Management Plan (FMP) to reduce harvest by 20 percent in order to end overfishing on the stock and remain in compliance with the FMP.

This notice will be published in issue 42 of the State Register, dated October 16, 2013.

Public Notice of Final Commissioner Policy
CP-59, Environmental Audit Incentive Policy

The New York State Department of Environmental Conservation (NYS DEC) has finalized a commissioner policy that incentives environmental audits. This policy encourages regulated entities to audit their operations and adopt effective approaches to prevent violations, including environmental management systems and pollution prevention, thereby improving compliance with environmental laws statewide and protecting public health and the environment. To support these actions, this Policy reduces or waives penalties for violations that are discovered and disclosed voluntarily, or discovered during pollution prevention or compliance assistance and encourages regulated entities to engage, during the ordinary course of business, in an environmental audit program. This commissioner policy also identifies incentives for regulated entities to go "beyond compliance" by agreeing to evaluate and incorporate environmental management and pollution prevention into their systems.

Pursuant to ECL 3-0301(2)(z), public comments were solicited earlier this year during a 60 day public comment period that closed on April 22, 2013. This final policy will be implemented beginning on November 18, 2013.

Draft Mid-term Revisions to the 2007 Filtration Avoidance Determination (FAD) for New York City's Catskill/Delaware Water Supply System

New York State Department of Health to Extend Public Comment Period for Draft Revisions to New York City's 2007 Filtration Avoidance Determination (FAD) to November 15, 2013:

In response to requests from stakeholders, the New York State Department of Health (NYS DOH) is extending the public comment period for the draft revisions to New York City's 2007 Filtration Avoidance Determination (FAD). NYS DOH along with the United States Environmental Protection Agency (US EPA), New York State Department of Environmental Conservation (NYS DEC), and the New York City Department of Environmental Protection (NYC DEP), have agreed to extend the comment period an additional thirty (30) days to November 15, 2013 to provide additional time for the public and other interested parties to complete their review. The draft Revised 2007 FAD may be viewed at: http://www.health.ny.gov/environmental/water/drinking/nycfad/
