No further review in accordance with SHPA is required.

The applicant is proposing the construction of a 476 square foot shed within the regulated 100 Foot Adjacent Area of NYS Freshwater Wetland OL-37, 20 feet from the wetland boundary. In addition to the shed, the applicant is proposing to stabilize approximately 20 feet of stream bank of Peekskill Hollow Creek [Waterbody Index #: H-55 portion, Class C(TS)] in order to protect the proposed shed from an eroding bank. This stabilization will be accomplished by placing rock rip rap along the bank and back filling with soil.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0026689), pursuant to 6 NYCRR Part 750-1.18. This modification is to revise the schedule of compliance in the existing SPDES permit for the Combined Sewer Overflow (CSO) Post Construction Monitoring program that was scheduled to occur in 2013. The Department recently completed a full technical review of the SPDES permit, pursuant to 6NYCRR Part 750-1.19, New York State's Environmental Benefits Permit Strategy (EBPS). Based upon this review, the SPDES permit was issued on January 30, 2013. Upon review of the Post Construction Monitoring Plan, submitted May 1 2013, it was determined that the schedule contained in the permit does not provide adequate time to collect the appropriate amount of samples in accordance with EPA's Combined Sewer Overflow Post Construction Compliance Monitoring Guidance, May 2012. EPA's Guidance states that when one of the designated uses of the receiving water body is recreation, the permittee will need to collect and analyze samples during the recreational season. The Yonkers Joint Wastewater Treatment Plant discharges to the Hudson River which is a Class SB water at this location. The best usage for a Class SB water is primary and secondary contact recreation and fishing. The Department is recommending that sampling consist of 5 samples per month from May to September for a total of 25 sampling events. In order to accomplish this, the post construction monitoring must be delayed until the 2014 season. The following changes to the permit are proposed - the SPDES permit compliance schedule for CSO Post Construction Monitoring on page 11 has been revised as follows: "The Permittee shall commence sampling by 5/7/2014" and "The Permittee shall submit an approvable CSO Post Construction Monitoring Report by 11/15/14" - In addition, as a result of discussions and an agreement with EPA, the Department has replaced the Recording, Reporting and Additional Monitoring Requirements permit language on the last page of the permit with 2 pages containing General Requirements and revised Recording, Reporting and Additional Monitoring Requirements.
