Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0024406). The City of Binghamton Combined Sewer Overflow (CSO) facility is tributary to the Binghamton-Johnson City WWTP. The City originally had out 45 overflow sites throughout the system. As a result of various projects, CSO outfalls have been reduced to 9 overflow points. Four sites are operated manually during emergency situation arises. Eight of the CSO outfalls discharge to the Susquehanna River (class A water), and one outfall discharges to Chenango River (class B water).

DEC proposes to incorporate the following modifications to this permit: -Administrative changes were made to page 1 of the permit. -Outfall coordinates were revised. -CSO Long Term Control Plan was updated. -SPDES General Requirements were updated. -The Monitoring Locations page includes a map showing CSO outfall locations. - The Recording and Reporting page was updated.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The New York State Department of Environmental Conservation (DEC) is proposing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0086479), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

Greene Technologies Inc., is a manufacturer of wire, tubular and sheet metal fabrications and parts. The facility has process wastewater that is treated with an ANDCO Wastewater Treatment System with Sand Filtration. The facility is permitted to discharge treated surface discharge to Birdsall Creek, a class C water.

The following changes to the permit are proposed: -WET testing requirements are listed as a footnote. -Best Management Practices requirements have been added. -A Schedule of Submittals for dye testing has been added. -The Monitoring Locations page has been updated. -SPDES Permit General requirements have been updated.

Project Description:

The Department has received a complete application from the Town of New Berlin for the proposed South New Berlin Water System Improvements. The action includes withdrawing up to 100,000 gallons per day from existing wells, the replacement of 1,200 feet of existing water main, installation of 550 feet of new main, construction of a new treatment plant, replacement of pumping equipment and controls within the old well house, demolition of the existing concrete reservoir and construction of a new water storage tank. A SPDES application is currently pending for the proposed discharge of backwash water from the treatment plant and will be public noticed separately when a draft permit is available.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: New Berlin Town Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 17, 2013.
