Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air Title V permit to Flexo Transparent, Inc. (Flexo). Flexo is a commercial flexographic printing facility which specializes in the printing of flexible packaging products. Flexo is subject to the Title V permitting requirements stated in 6NYCRR Part 201-6 for major facilities. The facility will limit VOC emissions to comply with two separate, previously accepted VOC emission caps. A 45 tpy VOC emission cap applies to four presses authorized under the original ASF permit. A 49 tpy VOC emission cap applies to the newest press. Both of the caps are included in this Title V permit which supersedes the two ASF permits. Flexo is subject to 40CFR63, Subpart KK Printing and Publishing as an area source. Flexo must verify that the facility's emissions of Hazardous Air Pollutants (HAPs) are less than 25 tons per year for total HAPs and less than 10 tons per year for any individual HAP. Flexo is subject to 40 CFR Part 64, Compliance Assurance Monitoring (CAM), since the facility has potential pre-control device VOC emissions greater than 50 tons per year, which is the major source threshold level, and a control device is used to achieve compliance with an emission standard.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.ny.gov/permits/6234.html.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

This streambank stabilization project consists of installation of 130 linear feet (LF) of longitudinal peaked stone protection with one stream barb and shaping and grading of 150 LF of the eroded bank directly downstream of the peaked stone. Also included is the placement of 150 LF of longitudinal peaked stone toe protection with 2 stream barbs using on-site material along the toe of bank upstream and plantings along the entire project length.
