Project Description:

The applicant proposes to develop and operate a 28.0 acre surface sand and gravel mine within a 54.2 acre parcel (Tax Parcel No.105.003-4-12) off of NYS Route 56. The project site is on property owned by Shawn Spellacy and lies on the eastern side of NYS Route 56, approximately 800 feet north of the intersection of Stowe Road and NYS Route 56. The mine is intended to operate as a traditional surface extraction of the Adams Sand, Berkshire Loam, Carbondale Muck, Croghan Loamy Fine Sand, and Nicholville Fine Sandy Loam soil types on the site. Mining is not proposed to take place below the local water table. Excavation will be done by mechanical equipment, standard for sand mining operations and for the removal of the material from a bank face. Mining is proposed to remove approximately 1.5 million tons of sand and gravel over the estimated 25 year operational life of the mine. Material will be mined and screened, and crushed as needed, with portable processing equipment standard for surface mining operations. Final reclamation will restore the site to a grass meadow. Mine areas will be graded and stockpiled topsoil will be spread around the edges, and seeded with perennial grasses and legume seed mixture. The reviewed life-of-mine (LOM) area is 28.0 acres.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Oct 25, 2013.
