Project Description:

The applicant proposes to renew an existing 13.4-acre gravel mine which includes a modification to expand their life of mine by 0.8 acres, for a new total 14.2-acre life of mine. Mining activities were previously approved to the south, east and west of the proposed expansion. The mine is located on Fuller Road between Sullivan Road and Telegraph Road.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (NYS DEC) has made a tentative determination to renew the 6 NYCRR Part 373 Hazardous Waste Management Permit to the United States Department of Energy.

Facility Description and Proposed Action:
The Knolls Atomic Power Laboratory (KAPL) is operated under contract with the United States Department of Energy (DOE). KAPL consists of two separate sites: the Kesselring Site and the Knolls Site, which are United States Government owned facilities. The Kenneth A. Kesselring Site (EPA ID No. NY5890008993; UPA No.5-4142-00005/00049), referred to as the Kesselring Site (KS), is the only site being addressed herein for the purpose of this Part 373 permit.

The principal function at the Kesselring Site is research and development in the design and operation of naval nuclear propulsion plants. Presently located on the Site are two operating pressurized-water naval nuclear propulsion plants and support facilities, including administrative offices, training facilities, equipment service buildings, a boiler house, cooling towers, and wastewater treatment facilities. The use of hazardous materials at the Kesselring Site is strictly limited to the types and quantities essential for operation. Transportation and disposal are limited to vendors operating under permits/licenses issued by the cognizant state and federal regulatory agencies. Information regarding the types of waste managed at the Kesselring site can be found in Application Attachment C. The Kesselring Site only receives, stores, and processes hazardous/mixed wastes it manages under the terms of this permit for shipment to offsite, licensed/permitted treatment, storage, or disposal facilities. A limited number of <90 day accumulation locations for hazardous/mixed wastes have been established in accordance with 6 NYCRR 373-1.1(d)(1)(iii) for waste storage prior to transfer to the Container Storage Areas (CSAs). Hazardous/mixed wastes that are generated and stored at the Site for greater than 90 days are maintained in the Building 75 and 91 CSAs.

This proposed action is a renewal of the Kesselring Site's existing 6 NYCRR Part 373 Hazardous Waste Management Permit, EPA ID No. NY5890008993. The renewal does not authorize an expansion in size or capacity of the Kesselring Site, but allows for the continued management of hazardous and non-hazardous wastes at the West Milton facility.

NYS DEC has prepared a Fact Sheet which provides further details on the draft Permit and the review process.

Tentative Determination:
The NYS DEC has made a tentative decision to issue the Permit renewal. A draft Permit has been prepared pursuant to the applicable regulations in 6 NYCRR Part 373-2 (Final Status Standards for Owners and Operators of Hazardous Waste Treatment, Storage and Disposal Facilities) as well as with all other applicable hazardous waste management laws and regulations.

How To Provide Your Comments:
Any interested person may submit comments. All comments in response to this notice must be in writing. All comments will be considered in making the final decision about issuance of the Permit. Should the NYS DEC decide to issue the Permit, a response to any and all comments submitted will be given which will identify any changes from the draft versions of the Permit and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice.
