The Department has made a tentative determination to approve an application for an existing facility that formerly held an Air State Facility Permit for Small Combustion Installation. The facility operates combustion installation consisting of three 26.5 mmBtu/hr boilers firing #6 fuel oil and emitting via a common stack. The facility NOx emissions are limited to 24.9 tons per year. The facility is subject to the provisions of State Facility requirements specified under 6NYCRR 201-7. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V modification to allow and approve NOx RACT variance on two Coltec IC engines that failed to meet the 2.3 gm/bhp/r limit, and to upgrade the burners on two boilers in order to meet the new 2014 NOx RACT limit of 0.0.08 lbs/MM Btu on both natural gas and #2 fuel oil by 7/1/14. The facility operates two mid-size boilers, three Coltec IC Engines, one combustion turbine, one duct burner, four Ethylene Oxide sterilizers with two abators, ten emergency generators, 36 fuel oil storage tanks and 15 fume hoods.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal 2 for a facility that will replace three boilers (two 23.4 mmBtu/hr Union Iron Works and one 31.6 mmBtu/hr Keepler boiler, both firing #6 fuel oil and two exempt emergency generators) and will install three new Cleaver Brooks boilers each rated at 20.412 mmBtu/hr. firing #2 oil and natural gas.
