Project Description:

The applicant proposes to discharge up to 2.9 million gallons per day of groundwater and stormwater from the existing Dolomite LeRoy Quarry to Mud Creek for mine dewatering. Mud Creek is a NYS-classified "C" stream that flows along the southern and eastern perimeter of the quarry. Current operations at the quarry involve pumping groundwater and stormwater from a collection sump within the mine site through two air strippers to treat any trichloroethene (TCE) that may be present, and then a discharge to collection ponds within the quarry property with resulting internal circulation. The proposed change would discharge the treated groundwater and stormwater via a new drainage channel to Mud Creek at a point about 1.5 miles from the confluence with Oatka Creek. A 0.17 acre expansion of the life-of-mine (LOM) boundary would be required to accommodate the new drainage channel. Otherwise, there are no changes proposed for the area or depth of approved mining, and there are no changes proposed to existing processing operations at the mine site.

The Department has made a tentative determination to issue an individual State Pollutant Discharge Elimination System (SPDES) Industrial permit for the proposed discharge described above. In addition to effluent limits for TCE and other parameters, the permit will include stormwater requirements that will replace the facility's current coverage under the SPDES Multi-Sector General Permit for Stormwater Discharges from Industrial Activity. As a tentative determination, the Department seeks comments on the draft permit, which is available for review at NYSDEC Region 8 in Avon, prior to making a final decision.

Project Description:

Bausch & Lomb Inc has submitted an application for an Air State Facility Permit for its Optics Center, located at 1400 North Goodman St in the City of Rochester. The facility emits air contaminants from three 37 million BTU per hour process steam boilers which can be fired by either natural gas or #6 fuel oil, contact lens manufacturing, processing, and packaging operations, two diesel powered emergency generators, and small exempt heating units.

Facility emissions are currently authorized by Emission Point Certificates to Operate, due to no significant changes in operations since 6 NYCRR Part 201‑6 (Title V) regulations became effective. The current Certificates to Operate include fuel usage restrictions to limit emissions of sulfur dioxide (SO2) and oxides of nitrogen (NOx) to below their 100 ton per year Part 201‑6 thresholds, and chemical usage restrictions to limit on emissions of volatile organic compounds (VOC) to below the 50 ton per year Part 201‑6 threshold.

With this application, Bausch & Lomb proposes to convert a previously exempt research production line to commercial contact lens manufacturing operations. Bausch & Lomb also proposes continue to restrict facility emissions of SO2 and NOx to below their 100 ton per year Title V thresholds, and to continue to restrict VOC emissions to below the 50 ton per year Title V threshold.

In response to the application, the Department has generated a Draft Air State Facility Permit including conditions to restrict SO2, NOx, and VOC emissions to below Title V thresholds on a 12 month rolling total basis. The Draft Permit also requires Bausch & Lomb to maintain records on site of fuel and chemical use and resultant emissions from the facility, for a minimum of five years. These records must be made available with all supporting data to Department inspectors upon request.

The Department has made a tentative determination to issue the Draft Permit as a Final Permit if comments received do not raise significant issues that must be addressed before a permit can be issued.

Applicant proposes to treat the Junius Ponds Unique Area with an herbicide to eliminate invasive vegetation, namely phragmites australis (Giant Reed) within State Freshwater Wetland GN-6 and GN-7 (both Class 1). The herbicide proposed for use is the liquid form of the active ingredient glysophate, trademarked and sold as Rodeo®. Treatment will be done within approximately a 5-acre area where severe concentrations of this invasive vegetation have been identified.
