Project Description:

The applicant, Norman Kohlbach, proposes to mine consolidated bluestone from a new 5.0 acre life-of-mine on a 60.7 acre parcel owned by Norman Kohlbach located at 38 Barton Road in Town of Windsor, Broome County. Previously a 1 acre DEC exploratory mining permit had been issued to mine and assess the bluestone quality and quantity. Typical blasting and processing of the material is proposed. Reclamation will be to wildlife and forest habitat similar to pre-mining conditions. No significant adverse impacts are expected.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0030317) for the surface discharge of 10 mgd average design flow via Outfall 001 of treated wastewater, and stormwater Outfalls 002, 003 and 004, to the Oneida River, a class B water.

Treatment at the facility consists of advanced secondary treatment using pure oxygen activated sludge process which includes, aerated grit chambers, automatic screen rakes, primary clarifier structures, pure oxygen activated sludge tanks, secondary clarifier tanks, aerated lagoons, and disinfection. Solids are removed via tanker truck to the Metropolitan-Syracuse wastewater treatment plant for further treatment.

DEC proposes to incorporate the following modifications to this permit: -Stormwater Outfalls 002, 003 and 004 have been added. -Mercury permit limit has been added. -Water Quality Based effluent limit for Total Residual Chlorine has been reduced. -Discharge Notification requirements have been updated. -Technology based effluent limits for CBOD5 have been added. -Action levels have been adjusted based on results of statistical analysis.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
