Public Notice

Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) is reviewing the application of Michael Craig of Miller Place, New York, to obtain an Off Bottom Culture Permit, including a Temporary Marine Area Use Assignment, which would allow the deployment of shellfish culture gear and the operation of shellfish culture activities on public underwater lands approximately 1,000 feet from shore, west of Mt. Sinai Harbor. The proposed Off Bottom Culture/Assignment site is a circular parcel approximately five acres in area, with a radius of 250 feet extending from a center point located in Long Island Sound at 40° 58' 09.00" North Latitude and 73° 03' 14.00" West Longitude. The proposed off bottom culture activities would involve the deployment of up to 80 cages each measuring 7 feet long x 3 feet wide x 5 feet high, at a depth of no less than 15 feet from mean low water. The shellfish species to be contained shall be Eastern oyster (Crassostrea virginica), hard clam (Mercenaria mercenaria), bay scallop (Argopecten irradians), soft clam (Mya arenaria) and surfclam (Spisula solidissima). There are no existing Temporary Marine Area Use Assignments within 1 mile of the proposed Off Bottom Culture/Assignment site. Initial review of the subject application does not identify any adverse or unreasonable effects on the viability, maintenance or use of local marine resources. Furthermore, this Off Bottom Culture/Assignment site was previously reviewed and permitted by NYS DEC in 1998 for a prior applicant engaged in similar activities, though the site has been inactive since 2001.

Public Comment: The subject application may be reviewed at the address given below, and specific comments on the requested permit, including the proposed Temporary Marine Area Use Assignment, or a request to become a party in interest if a public hearing is held, must be submitted in writing to the contact person named below no later than October 18, 2013. NYS DEC as lead agency has made an initial determination that this action will not have a significant effect on the environment. All correspondence should reference Application No. OBC A 11 13.
