The applicant proposes to construct a new micro brewery with a water treatment system comprised of two new septic tanks, a 1000 gallon for sanitary waste from tasting room and restrooms, and a 1500 gallon septic tank connected to a 1500 gallon tank with sequencing batch reactor to treat brewery waste, all leading into a leach field system which will generate a proposed discharge of 800 gallons per day of brewery waste and treated sanitary wastewater to groundwater from the facility located at 6621 State Routes 5 & 20, in the Town of East Bloomfield, Ontario County.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall project.

Applicant proposes to raze a 2-story structure, construct a parking lot, upgrade existing gravel boat launch to a 20-foot by 40-foot concrete launch, and install a new picnic area and a seasonal L-shaped dock with two-boat capacity. Proposed work is on the Erie Canal and includes approximately 30,500 square feet of disturbance within 100-foot adjacent area of State Freshwater Wetland PA-31 (Class 2). Approximately 20 cubic yards of soil will be excavated for concrete launch placement. In-water work will be completed during the drawdown level and coffer dam will also be used.
