The Department has prepared a draft permit and has made a tentative determination to issue a Title V Permit Renewal for a facility with two boiler rooms: main room consists of three Cleaver Brooks Boilers rated at 21.01 mmbtu/hr each; each boiler is capable of firing #6 fuel oil, #2 fuel oil or natural gas; second room consists of two Cleaver Brooks Boilers each rated at 10.5 mmbtu/hr capable of firing #4 fuel oil, #2 fuel oil or natural gas: also a Cleaver Brooks Boiler rated at 6.3 mmbtu/hr capable of firing natural gas, #4 fuel oil or #2 fuel oil, and two AERLO boilers rated at 1.0 mmbtu/hr each. The facility also contains one 750 kw, two 500 kw and one 50 kw (exempt) diesel engine generators for demand reduction and emergency purposes; one 50 kw (exempt) and one portable 70 kw (exempt) diesel generators for emergency purposes. The oxides of nitrogen emissions (NOx) for this emission unit are capped to under 25 tpy on a 12 month rolling period in order to avoid New Source Review 6 NYCRR Part 231-2 applicability. The facility is in the process of adding an emergency generator unit rated at 350 kw power output, Kohler Model 350REOZDD, for emergency use.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. The Department has made a tentative determination to approve an application for an existing facility that formerly held an Air State Facility Permit for Small Combustion Installation. The facility operates a combustion installation consisting of two 14.3 mmBtu/hr boilers firing natural gas or #6 fuel oil and one 27.9 mmBtu/hr boiler firing #6 fuel oil. The three boilers exhaust through a common stack. The facility NOx emissions are limited to 24.9 tons per year; and the facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7. The application, draft permit, relevant supporting materials and regulations are available for review during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated. DEC may schedule a public hearing based upon an evaluation of the nature and scope of any written objections raised. Hearing notices will contain instructions on filing for party status and submitting comments.

Records demonstrating compliance with this cap will be kept in accordance with the permit special conditions. Project Description:

The Department has made a tentative determination to modify an existing permit for an existing discharge of non-contact cooling water to modify the Biological Monitoring Requirements section in order to include conditions requiring a change in operations that will result in a reduction of impingement and entrainment by approximately 85%. This closed cycle cooling/electric chiller alternative is expected to meet the Best Technology Available requirements of Part 704.5 and the performance goals of CP-52. Additionally, the Total Residual Chlorine limit has been deleted from the permit because the facility no longer uses chlorine.
