The Department has received a Mined Land Reclamation application from Syracuse Sand & Gravel LLC for modification of mining operations at its Gifford Road Pit. Syracuse Sand & Gravel proposes a deeper excavation in a 16 acre section of the current Life of Mine area, to below the local water table. This will create a 12 acre pond surface extending to the northern lot line of the Gifford Road site. The northern lot line of the Gifford Road Pit site is also the southern lot line of the adjacent Lake Road Pit site, also operated by Syracuse Sand & Gravel LLC.

Concurrently, Syracuse Sand & Gravel is proposing a 0.3 acre expansion of the Lake Road Pit LOM area, to allow the excavations at the two mine sites to merge, creating a single 60.4 acre pond at the time of final site reclamation. The Lake Road Pit expansion is the subject of a separate Notice since it has been permitted separately from the Gifford Road Pit.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Phelps.

The applicant proposes a discharge of 10,946 gallons per day (gpd) of treated sanitary wastewater to groundwater from a sanitary treatment plant at the applicant's facility located at Route 54, Keuka Lake, Town of Wayne, Steuben County. The applicant is requesting a modification to the permit to include two new outfalls and increase the design flow from a total of 1,200 gpd to 10,946 gpd in response to the failure of the previous system.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
