Project Description:

The New York State Department of Environmental Conservation (DEC) has made a tentative determination to re-issue a State Pollutant Discharge Elimination System (SPDES) permit pursuant to 6 NYCRR Part 750 for the discharge of 130,000 gallons per day of treated sanitary wastewater, to the Fishkill Creek (Class Bt). The proposed discharge is associated with the existing Four Corners Sewer District Wastewater Treatment Facility. A draft SPDES permit (NY- 0270610) with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to modify an existing seawall which was severely damaged and rebuilt under DEC's General Permit for Hurricane Sandy General Permit, GP-0-12-006. The wall is proposed to be raised to a final elevation of 12 to 15 feet; the pre-Sandy wall was 9.4 feet and it was reconstructed to 10.9 feet, as allowed under the General Permit. The wall is also proposed to be extended by approximately 30 feet on the northern end with returns added to the north and south ends of the wall, approximately 60 feet long on the north and 160 feet long on the south. An area disturbed by an access road utilized for the reconstruction of the wall will be restored. No disturbance is proposed to vegetated tidal wetland.
