Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0030546) for the surface discharge of treated wastewater to Oatka Creek, a class C water.

The Village of LeRoy Wastewater Treatment facility provides secondary treatment for a design flow of 1.0 mgd. Treatment at the facility consists of debris size reduction/debris removal; grit removal; primary clarifier; fine bubble conventional activated sludge; and, final clarifier. Sludge is disposed to various landfills.

DEC proposes to incorporate the following modifications to this permit: -Short term high intensity monitoring requirements have been added for Bis(2-Ethylhexyl)phthalate. -Nitrogen Study requirement has been added. -Interim limit for phosphorus has been added. -Effluent limit and monitoring requirement for antimony and nickel have been removed due to detection concentrations below water quality based effluent limits. -Mercury Minimization Program for Low Priority POTWs has been added. - General conditions have been updated.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

Applicant proposes to treat the upper "Perkinsville Pond" with an herbicide to eliminate vegetation. The pond is within State Freshwater Wetland WA-7 (Class 2). The herbicide proposed for use is the liquid form of the active ingredient triclopyr, trademarked and sold as Renovate ® 3. A total of 2.5 acres of the pond will be treated where severe nuisance concentrations of water lilies (yellow and white) have been identified as interfering with fishing. Application rate will range between 2 and 8 quarts per acre, which is according to label directions. The water level will be controlled with the use of boards in the outlet. Approximately 750 feet west of treatment area there is a public water supply that serves the Village of Dansville in emergencies; however, this intake supply can and will be shut off prior to treatment for the appropriate time needed.
