The Department proposes to renew the State Pollutant Discharge Elimination System (SPDES) permit for the above referenced facility (NY 0029769) for a new 5 year term. In addition to the renewal, the Department is also proposing several modifications to the permit. The proposed modifications include addition of revised final permit limits for Ammonia (4.9 mg/l summer and 7.6 mg/l winter) beginning June 1, 2018, an interim effluent limit for Total Phosphorus (as P) of 1.0 mg/l in effect until June 1, 2018, a final effluent limit for Total Phosphorus (as P) of 492.8 lbs/year beginning June 1, 2018, a final effluent limit for Total Chlorine Residual of 0.05 mg/l beginning June 1, 2018, a minimum dissolved oxygen limit of 2 mg/l, addition of a schedule of compliance to meet these limits, addition of low priority Mercury Minimization Program in accordance with TOGS 1.3.10 and addition of short term monitoring requirements for Total Copper and Total Phenols. This facility is authorized to discharge a monthly average of 840,000 gallons/day of treated sanitary wastewater to Chautauqua Lake, a class A waterbody. A draft permit is available for review. The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

The Department has made a tentative determination to approve an application for replacement of the applicant's Air Title V permit with an Air State Facility (ASF) permit. The ASF permit limits facility-wide sulfur dioxide (SO2) and carbon dioxide equivalent (CO2e) emissions to below their major source thresholds of 100 tpy and 100,000 tpy, respectively. Because the ASF permit also contains the existing facility-wide limit of 99 tpy for oxides of nitrogen (NOx), it is not subject to the requirements of 6 NYCRR 227-2:Reasonably Available Control Technology (RACT) for Major Facilities of NOx and Title V.
