Project Description:

Roosevelt Fire District proposes to construct a 13,900 square foot fire station to be located on Violet Avenue (Route 9G) just south of the Wright Avenue intersection in the Town of Hyde Park. The new facility will encompass approximately 3.68 acres of the westernmost portion of the 12 acre vacant parcel.

An Incidental Take Permit is required because the Department has determined that the project may result in a "take" or "taking" of the Blandings's Turtle, which is listed as a threatened species pursuant to Environmental Conservation Law Section 11-0535 and 6 NYCRR Part 182.

This determination is based on the proposed conversion and subsequent loss of suitable nesting habitat used by the state-listed Blanding's turtle. This loss will be offset through compliance with the following mitigation measures to avoid, minimize or mitigate any adverse impacts to the state-listed species:

  • Avoidance of disturbance to NY State Freshwater Wetland HP-27 (core turtle habitat);
  • Retaining the services of a turtle monitor during construction, and for five years following construction, to complete site inspections and prepare an annual monitoring report to NYSDEC;
  • Construction of a permanent turtle exclusion fence along the eastern boundary of the proposed facility;
  • Management of upland areas east of the exclusion fence for nesting habitat on an annual or biannual basis;
  • Providing permission to NYSDEC to access areas east of the turtle exclusion fence for the purpose of further turtle study.

State Environmental Quality Review (SEQR) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Project Description:

The Department has made a tentative determination to approve this application for modification to an existing SPDES permit # NY-0165972 for Chaviva Properties, located on Ulster Heights Rd. in Wawarsing. The applicant proposes to replace an existing 10,740 gpd sand filtration system with a new 21,480 gpd sand filtration system for a summer camp facility. The existing outfall will be removed and a new outfall constructed. The SPDES permit is being modified to reflect the proposed flow increase as a result of the expansion of the wastewater treatment system. The proposed discharge of treated sanitary wastewater is to an Unnamed Tributary of Botsford Brook, a Class B(t) waterbody.

The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.

A SPDES Permit Statement of Basis and draft SPDES permit with DEC proposed effluent limits and monitoring requirements are available for review at the DEC Region 3 headquarters in New Paltz.
