Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to approve this Title V Air Permit renewal for Keywell, L.L.C. which owns and operates the Vac Air Division at 300 Falconer Road. The facility processes stainless steel, high temperature alloys and titanium scrap metal for consumption by industry. Keywell has chosen to limit Hazardous Air Pollutants (HAP) to less than 10 tons per year for individual HAPs and below 25 tons per year for total HAPs. The total HAPs limit ensures the gas-fired boilers are not subject to 40CFR63 Subpart DDDDD - National Emission Standards for Hazardous Air Pollutants (NESHAP) for Major Sources: Industrial, Commercial, and Industrial Boilers and Process Heaters, final rule February 1, 2013. The facility continues to be subject to the Halogenated Solvent Cleaning NESHAP 40CFR63 Subpart T. Permit conditions related to titanium torching and blasting operations have been taken out of the draft permit since those operations have been moved to the Falconer plant and are now permitted under registration ID 9-0638-00219/00001.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The applicant proposes a streambank stabilization project on Murder Creek upstream of the Mechanic/Main Street bridge. The project includes installation of approximately 205 linear feet of stacked and pinned heavy stone fill, 125 linear feet of large single pinned toe rock and multiple riparian plantings to promote soil stability. Standard sediment and erosion controls including a temporary diversion channel or cofferdam and silt fencing will be used to maintain the water quality of Murder Creek. Also, several leaning trees will need to be removed.

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit modification to the Attica and Wyoming Correctional Facilities. These two prisons are contiguously located on the same property in the Town of Attica, Wyoming County. One Air State facility permit covers both facilities. This modification is to include a Greenhouse Gas emission cap to avoid Title V permitting requirements and add a temporary boiler that will be used during a construction project. New and revised regulatory requirements were also added.

This permit caps the Greenhouse Gas emissions at 99,000 tons per 12-month rolling total as carbon dioxide equivalents to stay below the 100,000 tons per year Title V permitting threshold.

A 12.8 MMBtu/hr temporary boiler will be used for an onsite boiler upgrade construction project. This boiler is exempt from the New Source Performance Standards for Small Industrial-Commercial-Institutional Steam Generating Units, 40CFR Subpart 60 Dc, if it is on site for less than 180 consecutive days and the potential SO2 emissions rate is no greater than 0.060 lb/MMBtu. None of the existing emission caps limits changed.

The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
