Project Description:

The applicant proposes to reinstate the expired SPDES permit, NY-0159069, for the existing discharge of 2,000 gallons per day of treated sanitary wastewater to a ditch flowing into Bigalow Creek, a Class C waterbody, from a spectic tank and sand filter treatment plant at the applicant's golf course and restaurant located at 7909 Batavia-Byron Rd. in the Town of Stafford. The applicant plans to operate the system on a seasonal basis, approximately 9 months per year.

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall project.

State Environmental Quality Review (SEQR) Determination:

Project Description:

Waste Mangement of NY is applying for modification of their current Article 27 permit to construct and operate an intermodal rail facility at the High Acres Landfill & Recycling Center (HALRC) for the transport of solid waste. The project will provide rail service to HALRC via CSX Transporation. The project will consist of 18,800 track feet of new tracks with approximately ten (10) acres of new developed area consisting of ballast track and gravel maintenance roads. During construction, the site will have approximately seventeen (17) acres of ground distrubance of which seven (7) acres will be temporary disturbance. Impacts to wetlands will be avoided. No other changes to the currently permitted volume and type of waste or other operations at the facility are being proposed.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Macedon Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
