Project Description:

The applicant proposed to construct a bike/pedestrian trail through New York State Department of Conservation's wetland MV-13 and its adjacent area. Approximately 900 linear feet of trail is planned to cross the wetland and its adjacent area. The trail through the wetland will be a 6 foot wide elevated boardwalk. The wetland would be leveled by hand to place the sill foundations on a level surface. The project is located on the East side of Banker Road, between Tom Miller Road and State Route 374.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department intends to modify the permit for an existing discharge of up to 1333 gpd of treated sanitary wastewater to the West Branch of the Ausable River from the restaurant's treatment plant. The modification is necessary due to recent changes made to the treatment system which requires a change in permit limits. The previously existing 2500-gallon septic tank was replaced with a 2000-gallon tank in May 2013. Therefore, the permit limits for flow, BOD and TSS load limits have been reduced in consult with NYS DOH and in accordance with the DOW TOGS. The dates of the seasonal limits were changed from June thru September to May thru September to more accurately reflect the recreational use of the river and to be consistent with other SPDES-permitted facilities in the watershed. The Settleable Solids (SS) numeric limit was decreased from 0.3 ml/L to 0.1 ml/l and the sampling frequencies for pH and SS were changed from weekly to daily in accordance with TOGS 1.3.3.
