Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a new Mined Land Reclamation permit for the proposed mining of 27.4 acres within the planned 31.3 acre Life of Mine Limits at 1055 Mapes Road in the Town of Willing. The total property is 151 acres. A new haul road is also proposed to be constructed to provide access to Mapes Road. The mining operation will not have a wash plant and will be a surface unconsolidated mine for the extraction of sand and gravel. The reclamation objective is agricultural land and non-agricultural meadow. The Department has made a tentative determination and is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement for which a permit is sought.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Mark I LLC proposes to construct a multi-use business park located on 210 acres of land for commercial, industrial and multi-family residential uses. Phase 1 includes 2 on-site water wells and the withdrawal of up to 50,000 gallons of water to be used by future users such as townhouses, a strip plaza, retail stores and restaurants. A 13 townhouse unit project along Hutchinson Road includes a 2900 gallons per day on-site wastewater treatment system with a discharge to groundwater and a Protection of Water Permit for a stormwater management pond outlet to Cattaraugus Creek. Future project components will be reviewed and public noticed as information becomes available and in accordance with regulatory requirements.
