Project Description:

The new owner has applied for re-issuance of the previously expired permit to discharge 8,700 gallons per day of treated sanitary waste from the existing Willow Creek Estates Mobile Home Park sanitary system, comprised of a 10,000 gallon septic tank and buried sand filter, to a ditch that drains into an un-named tributary of Ganargua Creek, ONT 66-12-52-23-22-1-2, a Class C waterbody, that then drains into the Barge Canal. The park is located on the east side of State Route 21 in the Town of Manchester, Ontario County.

The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance.

As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 23, 2013.

The applicant proposes to install new armor stone revetment along approximately 105 lineal feet of shoreline on Lamoka Lake. The revetment will be placed at or below mean high water level for erosion control. The bank will be cut back to create a 2 on 1 slope. The proposal requires an Article 15 Protection of Waters permit.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
