Project Description:

The applicant proposes to expand the existing sand and gravel mine to add 37.6 acres of land to the currently approved 8.9 acres of life of mine area. The project site is the applicant's property, located immediately northeast of the Interstate Route 81 Kellogg Hill exit. It is about six miles north of Adams and seven miles south of Watertown, in the Town of Adams. The existing access road is located on the west side of US Route 11. The mine is intended to operate as a traditional surface extraction of the Plainfield sand, which is the predominated soil type on the site. Mining is proposed for below the local water table. Excavation will be done by mechanical equipment, standard for sand and gravel mining operations, and for removal of material below the local water table. Mining is proposed to remove approximately 40,000 tons-per-year of sand and gravel over the estimated 30 year operational life of the mine. Material will be stockpiled as unprocessed "run-of-bank", or processed with portable screens and crushers. Maximum processing rates for the screen and crushing operations will not exceed 150 tons-per-hour (TPH). Final reclamation will restore the site to a uniformly graded and re-vegetated open land. Up-land reclamation will include the replacement of stockpiled topsoil, and re-seeding with an approved USDA SCS seed mixture. The reclamation plan includes one or more small ponds approximately 11 acres and two to twenty five feet in depth.

The proposed mine expansion includes approximately 13 acres of an abandoned sand pit to the south and additional wooded land to the north of the existing mine limits. Mining was originally permitted here beginning in 2009 and has continued ever since. The reviewed life-of-mine expansion area is 37.6 (LOM) acres.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the facility's Title V permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
