The applicant proposes to renew a State Pollutant Discharge Elimination System (SPDES) Industrial Permit for an existing discharge of 2,500 gallons per day of treated vehicle rinsing and storm water to an unnamed tributary of Wappinger Creek, [index # HR101-6-2, Class C(T)] at the United Parcel Service Distribution Center, located at 41 Firemens Way approximately 2000 feet south of Route 55 and east of Noxon Road in the Town of LaGrange. The facility had a previous permit (now expired) from the Department (DEC) for the existing discharge. The facility contains a car wash, auto shop and fuel islands.

The DEC has made a tentative determination to approve this application for issuance of SPDES permit # NY0149489 under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the DEC at this time. A draft SPDES permit with proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

The applicant proposes disturbance to NYS wetland YL-1 (class 2) totaling approximately 3 acres on the 44-acre Treasure Lake. Channels from 23 properties will be hydro-raked along with access channels to the open water outside the wetland. The individual property channels will each be a maximum of 15 feet wide and the main access channel will be 30-feet wide and extend for approximately 4,300 linear feet along the east, south, and west sides of the lake. Vegetation removed will be composted at the Emerald Green Property Owners Association's property off of Old Sackett Road.
