The Department has made a tentative determination to approve an application for an existing facility that formerly held a General Permit for Small Combustion Installation.

The facility operates the following combustion sources: four new identical Caterpillar C27 (2008 manufactured) engines each with a capacity of 705 kW and one older 600 kW Rudox RM 900S generator/engine. All five engines are on the 13 floor and vent via a common stack; also all five participate in the coordinated demand reduction program, (CDRP). Two identical older engines on the ground floor vent via an independent stack and also participate in the CDRP. One new 1500 kW Caterpillar 3512C generator has been installed in the basement. for emergency purposes only and is an exempt source. Other exempt sources include five 15,000 gallon underground storage fuel tanks and three 275 gallon above-ground storage fuel tanks. The facility NOx emissions are limited to 24.9 tons per year. The facility is subject to the provisions of State Facility requirements specified under 6 NYCRR 201-7.

The Department has made a tentative determination to approve an application for an existing facility that holds a Title V Permit and now will have an Air State Facility by capping out of Title V by limiting the NOx emissions to 24.99 tons per year. The ASF application is for a facility modification to include the following: 1. Remove two existing 1000 KW each engine generators on June 30, 2013, (noting that one generator was never installed); 2. Install a new 815 HP (608 KW) generator; capping the facility's NOx emissions below 24.99 tons per year by limiting the #2 diesel fuel use to less than 217,900 gpy. The facility will operate three engine-generators. The facility will no longer be considered a major source of NOx and not subject to Title V or NOx RACT requirements.
