Negative Declaration

Erie County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed South Peppermint Road Pit will not have a significant adverse environmental impact. The action involves the excavation of approximately 800,000 cubic yards of unconsolidated sand and gravel from 14.9 acres of a 48.6 acre parcel. Construction and demolition material will be stockpiled at the center of the site as an operation separate from the mining activity. Reclamation will be concurrent with the mining operations and will create open space and wildlife habitat using stripped overburden, topsoil and a select seeding mixture. The site is located approximately 0.3 mile east of the intersection of Peppermint Road and Pavement Road in the Town of Lancaster, New York.
