Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modified Air State Facility Permit for the operation of the cogeneration facility at Hudson Valley Community College, 80 Vandenburgh Avenue, City of Troy, Renssealaer County. The permit incorporates 40 CFR 63, Subpart ZZZZ which requires the facility to attain a 93% carbon monoxide reduction from natural gas fired engines and a 70% reduction of carbon monoxide emissions from the diesel fired engine. Also, the engines that previously utilized landfill gas will now utilize natural gas. The facility also permitting diesel fuel fired engine.

Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative below. The Department has prepared a draft permit and has made a tentative determination to issue a modified Air State Facility permit to include a capping condition for CO2 at this facility. This capping condition is being added in response to the Environmental Protection Agency's, Prevention of Significant Deterioration and Title V Greenhouse Gas (GHG) tailoring rule promulgated on June 3, 2010. This permit modification includes an enforceable emissions cap limiting GHGs to less than 95,000 tpy CO2e. This permit also includes changes to incorporate applicability of 40 CFR 63, Subpart JJJJJJ.
