The project is located at 385 Glenwood Road in the Town of Warwick. A draft permit is available for inspection and comment at the regional office.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes a surface discharge of up to 7,200 gallons per day (GPD) of treated sanitary wastewater to a tributary of Little Black Lake, a Class B waterbody [index No. D-10-15- p103-2a (0.6)], from a sub-surface sand filtration treatment system at the applicant's facility located at 1761 State Route 17 B, Town of Bethel. The facility had a previous permit (now expired) from the Department ("DEC") which authorized a discharge of up to 4,200 GPD. The increase discharge of 3,000 GPD is based on current treatment capacity of the facility.

The DEC has made a tentative determination to approve this application for issuance of State Pollutant Discharge Elimination System (SPDES) permit # NY 014 8369 under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the DEC at this time. A draft SPDES permit with proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Title V Air Facility Permit for the operation of IBM Thomas J. Watson Research Center. The Facility maintains the following air emission sources: Three boilers, each rated at 32.2 MMBtu/hr to be de-rated below 25 MMBtu/hr operating on No. 6 fuel oil; four emergency generators, rated at 1500 KW, 1500KW, 300 KW and 250 KW; three above ground propane tanks; and various exempt sources such as laboratory hood, space and water heaters. The facility is a major for NOx and will comply with 6NYCRR Part 227-2 NOx RACT requirements for small boilers.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
