Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the existing State Facility Permit for the operation of 110 Clean Fill Disposal Site located at 136 Bethpage-Spagnoli Road, Melville, NY 11747. The 110 Sand Company operates a Clean Fill Disposal Site (CFDS) in Melville, NY. This application is for an Air State Facility Permit continued operation of a Paques THIOPAQ sulfur removal technology on the existing landfill gas collection and flare system. During normal operation, gas generated by the degradation of the clean fill is captured by a gas collection system. The gas is conveyed to a biological treatment system known as Thiopaq. Thiopaq is a state of the art sulfur removal technology, which utilizes biomass to treat the collected gas. The treated gas is then conveyed to a flare for final treatment. In the event the Thiopaq treatment system is not operational, gas is conveyed directly to the flare. In order to continue to remain below the applicability threshold for Title V permitting, the applicant has proposed restricting the potential to emit through enforceable permit conditions which will limit or cap emissions at a level which is less than 90 tons per year for sulfur dioxide . The applicant has agreed to permit conditions which will limit sulfur dioxide emissions by treating the landfill gas prior to combustion. The facility will be required to maintain records and report this data to verify compliance with permit conditions and limits.

Persons wishing to inspect the subject Air State Facility files, including the application, with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the DEC representative listed below. A copy of the DEC's permit hearing procedures is available upon request or on the DEC web site at: http://www.dec.ny.gov/permits/6234.html. If comments are received which raise significant issues or provide additional relevant information, the DEC may modify the draft Air State Facility Permit.
