Notice of Adoption to Amend 6 NYCRR Part 44

Pursuant to the Environmental Conservation Law sections 11-0303, 13-0105 and 13-0329-16, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Notice of Adoption to amend 6 NYCRR Part 44 pertaining to lobster regulations. This rule making will adopt a closed season in Lobster Conservation Management Area (LMA) 4 (ocean waters off the south shore of Long Island). This rule making was adopted as an emergency rule making on January 31, 2013. The harvest and landing of lobsters from LMA 4 will be prohibited from February 1 through March 31. During the closure, lobster permit holders who use lobster traps or pots will have a two week period to remove lobster pots from the water after the closed season begins and may set un-baited lobster traps or pots one week prior to the end of the closed season. Permit holders who designate multiple LMAs on their permit must abide by the "most restrictive rule" which requires them to cease fishing in all areas listed on their lobster permit should any LMA listed there be closed. In addition, 6 NYCRR Part 44 will be renumbered to create space for the new rules and make the lobster regulations more consistent with the remainder of Part 44 (horseshoe crabs and crabs).

This rule making is necessary to reduce lobster harvest by 10% and to remain in compliance with the Atlantic States Marine Fisheries Commission Interstate Fishery Management Plan for the American Lobster.

Clean Water State Revolving Fund FFY 2013 Intended Use Plan Additional Annual List Project

The New York State Environmental Facilities Corporation (NYS EFC) administers the Clean Water State Revolving Fund (CWSRF) on behalf of the New York State Department of Environmental Conservation (NYS DEC). This provides public notification of a change to the Annual Project Priority List in the Federal Fiscal Year (FFY) 2013 Clean Water State Revolving Fund Intended Use Plan (IUP).

The New York State Energy Research and Development Authority (NYSERDA) Project C4-9171-01-00 is being added to Category C in the Annual PPL for an amount of $25,000,000. CWSRF financial assistance will support NYSERDA's residential energy efficiency program established under the Green Jobs-Green New York Act of 2009 (GJGNY). The GJGNY program is a statewide program to promote energy efficiency and the installation of clean technologies to reduce energy costs and reduce greenhouse gas emissions. The program is available to residential (1-4 family) dwelling units across the state.

NYSERDA is seeking market-rate financing in FFY 2013. Section 3.6 for the FFY 2013 IUP allows minor modifications to the IUP through the publication of a notice in the ENB. Such minor modifications cannot affect overall funding levels or priorities.

Final Amendment No. 1 to the Drinking Water State Revolving Fund Federal Fiscal Year (FFY) 2013 Intended Use Plan

FFY 2013 Readiness List Project Amendments:

Draft Amendment #1 to the Drinking Water State Revolving Fund Intended Use Plan issued October 1, 2012 was published in the May 22, 2013 issue of the Environmental Notice Bulletin. The comment period for the Draft Amendment #1 closed on June 5, 2013. The New York State Department of Health (NYS DOH) received no public comments pertaining to this amendment. Therefore, the amendment to the Drinking Water State Revolving Fund Intended Use Plan is final as shown below:

Ellisburg (V), Jefferson County DWSRF#17201- The project score is amended from 135 points to 150 points. The project was originally scored in 2002 and after a recent routine score re-evaluation it was determined that although eligible, the project was not provided C-2 (f) points for Storage and C-6 points for meters.

Herrings (V), Jefferson County DWSRF#17562- The borrower name is amended from Herrings (V) to Deferiet (V).

Kiryas Joel (V), Orange County DWSRF#16906- The project description is revised to add "New Ground Water Source" which is consistent with the original scope of the project as it is a source water project. All permits, SEQRA, as well as all required state and local approvals will need to be satisfied for this inclusion of the ground water source work into the project.

NYS DOH has determined that the project amendments are necessary and reasonable. The project amendments will not adversely affect any project on the IUP Project Readiness List above the funding line. Except for the above-noted changes, there are no other changes to projects listed on the Project Readiness List.
