Project Description:

The Department has made a tentative determination to approve this application for re-issuance of a SPDES permit (#NY 027 0806) to allow a subsurface discharge from three separate outfalls (Outfall Nos. 001, 002 & 003) of 14,400 gallons per day (gpd) of sanitary wastewater in conjunction with the construction of a 24‑lot residential subdivision on a 106+ acre parcel. The (3) outfalls will be operated in rotation, and only two of the three outfalls will be operated at any given time. The project associated with this SPDES permit was originally proposed as a 28-lot subdivision and a SPDES permit was issued by DEC on 4/1/06. The project was not built during the permit term (permit expired 3/31/11) and the SPDES permit lapsed. The applicant seeks re-issuance of the SPDES permit. The project is located on the north side of Kennicut Road, approximately 1000 feet east of the intersection with Teakettle Spout Road in the Town of Carmel. A draft permit is available for inspection and comment at the regional office.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Carmel Town Planning Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 05, 2013.
