Project Description:

Silgan Containers Corp has submitted an application for renewal of its Title V Facility Permit for its Lyons Plant, which manufactures metal and composite cans. Plant operations include metal surface coating, drying, and welding. The Lyons Plant meets the definition of a major stationary source in 6 NYCRR Part 201-6, and is required to maintain a Title V Facility Permit, due to potential emissions of volatile organic compounds (VOC) of over 50 tons per year.

The Title V Facility Permit was originally issued February 27, 2001, and was renewed September 19, 2007. Silgan proposes to continue to limit coating use and to continue to operate thermal oxidizer control equipment to restrict potential emissions of all hazardous air pollutants (HAP) from sheet metal coating processes to less than 25 tons per year, and to restrict emissions any individual HAP substance to less than 10 tons per year, the applicability thresholds in 40 CFR 63 Subpart KKKK Maximum Achievable Control Technology (MACT) regulations for Surface Coating of Metal Cans.

In response to the application, the Department has prepared a Draft Title V Permit and has made a tentative determination to issue the Draft Permit as a Final Title V Facility Permit, if comments received do not raise significant issues that must be addressed before a permit can be issued. The Draft Title V Permit includes conditions that specify control equipment operation and coating use record keeping sufficient to continue to demonstrate that HAP emissions will remain limited to below the 25 ton per year total HAP and 10 ton per year individual HAP thresholds in 40 CFR 63 Subpart KKKK. With these requirements, the Lyons Plant will not be subject to Subpart KKKK MACT regulations.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jun 14, 2013.
