Project Description:

The Department has prepared a draft permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application modification for the Hyland Facility Associates (Hyland) Landfill located at 6653 Herdman Road, Angelica, New York. Hyland is proposing an increase in the approved design capacity from 312,000 tons per year (tpy) to 465,000 tpy, which will result in a maximum increase of the landfill gas generation rate from 2,941 cubic feet per minute (cfm) to 3,511 cfm. The landfill gas will be controlled by the existing engines and open flare. The proposed project is a New Source Review (NSR) major modification for greenhouse gas (GHG) emissions. As required by 6NYCRR Part 231-8.7, the Department has determined the Best Available Control Technology (BACT) for GHG emissions from the Hyland Landfill includes: (1) Early implementation of the New Source Performance Standards (NSPS) Subpart WWW capture and control requirements, (2) Early implementation of the National Emission Standard for Hazardous Air Pollutants (NESHAP) Part 63 Subpart AAAA , and (3) Extended operation of the capture and control system beyond the NSPS closure requirements.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modified Air State Facility permit for Dunkirk Specialty Steel, LLC located in the City of Dunkirk. This proposed modification includes removal of emission source G02, a Cleaver Brooks boiler which has been decommissioned and addition of two existing emergency generators that are now subject to 40 CFR 63 Subpart ZZZZ. The proposed modification also includes a correction to the capacity size of the four Round Mill furnaces and the four Shape Mill furnaces. The required annual maintenance shutdown of the scrubber is proposed to be changed to an as-needed basis. The addition of a performance test requirement and modeling impact evaluation of the pickling process to evaluate the performance and compliance with ambient air quality standards and required control efficiencies is also proposed. The performance test shall be completed once during the term of this permit modification prior to June 7, 2016. The proposed modification also updates the NOx cap emission equation to reflect the change in combustion sources and removes the carbon monoxide and particulate emission caps because the facility potential to emit values are less than 100 tons per year for these contaminants based on removal of combustion sources and re-calculation of emission estimates. The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.

The Department has prepared a draft permit and has made a tentative determination to issue a permit renewal for this natural gas transmission/storage facility, which consists of nine natural gas fired stationary reciprocating internal combustion compressor engines, six of which are 2-cycle lean burn engines rated at 1,400 horse power (HP) and three that are 4-cycle rich burn engines rated at 438 HP. All of the engines are subject to the opacity limitations of 6 NYCRR Part 227-1.3(a) and the nitrogen oxides (NOx) limit of 6NYCRR Part 227-2.4(f)(1). The 2-cycle lean burn engines are subject to an approved alternative NOx emission limit of 6.0 grams per brake horsepower-hour (g/bhp-hr) and the 4-cycle rich burn engines are subject to the NOx emission limit of 1.5 g/bhp-hr. The company will limit benzene emissions to 0.90 megagrams per year, which is federally enforceable, so that the dehydration system can be considered a small glycol dehydration unit as defined at 40CFR63.1271 Subpart HHH. The dehydration unit is also subject to 6NYCRR Part 212.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.3(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
