The Department has made a tentative determination issue a permit modification to the Part 360 Solid Waste Management Permit issued to J.C. Fibers, Inc. at an existing 800 ton per day construction and demolition (C&D) debris transfer station and waste paper recycling facility. The modification includes the operation of a Municipal Solid Waste (MSW) transfer station and to increase the approved design capacity to 1600 tons per day. The existing building is proposed to be used for the MSW transfer station. As a tentative determination, the Department seeks comments prior to making a final decision.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Section 401 - Clean Water Act Water Quality Certification

Project Description:

A modification of the Seneca Falls Power Corporation (SFPC) Section 401 Water Quality Certification is proposed for its Waterloo and Seneca Falls hydroelectric project. The modification would alter the manner in which water level fluctuations in the Seneca-Cayuga Canal and VanCleef Lake are monitored and restricted. At the Waterloo facility, the Cayuga-Seneca Canal water level will be managed to stay within 0.5 foot of the daily average surface elevation measured at the New York State Canal Corporation's (NYSCC) Geneva gage on Seneca Lake. At the Seneca Falls facility, the water elevation of VanCleef Lake will be managed at a target elevation of 430.5 feet, with a maximum daily water level fluctuation of 0.25 foot. Additional water level recording and reporting requirements are also proposed to ensure compliance with required water level management. Both facilities are also operated under a license issued by the Federal Energy Regulatory Commission (FERC License No. 2438).

New Breakwall With Toe Protection: Applicant proposes to stabilize bank by installing an approximately 140 foot breakwall on Seneca Lake that is above mean high water level (MHWL) with toe stone protection in front of the wall that extends below MHWL, requiring an Article 15 Protection of Waters permit. The angular toe stone will be placed at the base of the wall to prevent scour and provide habitat. As a tentative determination, the Department is seeking comments prior to making a final decision.
