Project Description:

The applicant proposes disturbance to the 100-foot adjacent area of NYS Freshwater Wetland HJ-19 (class 1) for paving of a gravel driveway, removal of an asphalt driveway, and installation of permanent 100-foot adjacent area markers, associated with subdivision and development of a residential lot and lot line adjustments for 2 additional lots, on parcels totaling approximately 24 acres. Each lot contains portions of NYS Freshwater Wetland HJ-19 and regulated 100-foot adjacent area. The applicant proposes to allow revegetation of the 100-foot adjacent area as mitigation. The Department has determined that this action is likely to result in a taking of habitat of NYS-listed species Blanding's turtle (Emydoidea blandingii). The applicant has proposed a threatened species mitigation plan which can be made available for inspection during normal business hours by scheduling an appointment with the contact person listed below.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification for a State Facility Permit for the operation of the Woodbourne and Sullivan Correctional Facilities which are located in the Town of Woodbourne, Sullivan County, New York. The facility is primarily heated by the operation of one 29.3 MMBtu/hr and three 20.92 MMBtu/hr boilers. All four small boilers are located in the main powerhouse and vent to individual stacks. Consent Order 3-20000303-95 (executed April 18, 2001) requires each powerhouse boiler to fire only 0.2% sulfur No. 2 fuel oil. The facility also operates seven emergency generators which are utilized in the energy demand response program. Primary pollutant emissions have been limited below major stationary source thresholds as defined under permit conditions under 6NYCRR 201-7. The Standard Industrial Classification Code representative of this facility is 9223 - Correctional Institutions. Modification 3: The facility's emissions of greenhouse gases are capped below major stationary source threshold with an emission limit of 198,000,000 pounds carbon dioxide equivalents per year. The modification also includes the addition of a general applicability condition for EPA's area source boiler MACT (40 CFR 63 Subpart JJJJJJ) and minor administrative changes to update permit format. By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit. Persons wishing to inspect the subject files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representatives listed below.
