Negative Declaration

Allegany County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Herbicide Application to Control American Beech, Multiflora Rose and Common and European Buckthorn on Rattlesnake Hill Wildlife Management Area, Compartments 8, Stand 5 will not have a significant adverse environmental impact. The action involves an herbicide application to control American beech and shrubs including Multiflora rose and Common and European buckthorn. The 105 acre area will be treated with the commercial herbicide Mad Dog Plus (EPA registration No. 34704-MS-001), active ingredient glyphosate, registered for use in New York State. Control of the target species will allow the establishment and regeneration of desired hardwood species such as oak and maple to re-occupy the area without interference from competing undesirable species.

This action is part of a plan to regenerate stand H-5 with desirable hardwood species and is consistent with the Livingston Unit Management Plan completed in 2000. The present cover type is designated as transition hardwood, consisting of mature and over mature oaks, maples and ash.

The project is located off England Hill Road on Rattlesnake Hill Wildlife Management Area in the Town of Grove, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Site Plan for Dockside Village Townhomes will not have a significant adverse environmental impact. The action involves the construction of three (3) 2-story buildings with four (4) townhouse units each. Each building will have 2 driveways to Dockside Parkway. The subject property is located on the south side of Dockside Parkway 2,300 ± feet west of Transit Road and also described as the western terminus of Dockside Parkway. The parcel is located within 100 feet of New York State Department of Environmental Conservation (NYS DEC) Wetland CC-45. The project is located at 268-322 Dockside Parkway, in the Town of Amherst, New York.

Erie County - The Town of Amherst Town Board, as lead agency, has determined that the proposed Local Law to Permit Raising Chickens in Certain Residential Districts will not have a significant adverse environmental impact. The action involves a proposed local law which will permit up to six (6) chickens to be raised on property located in the Rural Residential (R-R) District and Residential Districts One, Two, Three and Four (R-1, R-2, R-3 and R-4) for a maximum of two (2) years upon approval of a Special Use Permit by the Zoning Board of Appeals. The entire site is designated as State or federal wetlands. The project is located in the Town of Amherst, New York.
