The Department has drafted a permit and made a tentative determination to approve this application for renewal of SPDES Permit No. NY-0204226 for an existing discharge of up to 1,800 gallons per day of treated sanitary wastewater into a storm sewer tributary to Cattaraugus Creek, a Class C(t) stream, from an on-site septic tank, sand filter and chlorination system. Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0026336) for the surface discharge of 32 mgd of treated wastewater and or stormwater to the Niagara River, a class A-special water.

Treatment at the facility consists of granular activated carbon beds. Both separate and combined sewers convey sewage to the facility. Sludge is thickened by gravity and further dewatered by a belt filter press. Post dewatering the sludge is stabilized by lime and then hauled to landfill. DEC proposes to incorporate the following modifications to this permit: -Effluent limits for Bioaccumulative Chemicals of Concern have been updated. -A Pollutant Minimization Program has been added. -Monitoring for Total Dissolved Solids, and seasonal monitoring for Enterococci have been added. - The limit for Total Phenolics has been reduced.

Article 19 Air State Facility

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit for Taylor Devices located at 1 Buffalo Bolt Way, in the City of North Tonawanda. Taylor Devices proposes to manufacture products used to absorb, control, or mitigate the motion of masses. Products include, but are not limited to, fluid dampers, shock absorbers, liquid springs, crane bumpers, etc. Emission sources consist of four spray booths, welding/brazing, grinding/sanding, and grit blasting/tumble blasting equipment. This proposed permit contains a federally enforceable emission cap to limit toluene, a hazardous air pollutant, to less than the 10 ton major source threshold during any consecutive twelve month period. This cap will establish the facility as a minor source and therefore not subject to the Title V permitting requirements of 6NYCRR, Part 201-6. Surface coating operations are subject to the requirements of 6NYCRR, Part 228-1. The facility potential to emit of volatile organic compounds (VOC) is 31 tons per year. As such, the facility will not be subject to the "as applied' limits of Table 2 for those products which fall into the aerospace coating definitions since Table 2 has a 50 ton applicability threshold. The coating operations will also be subject to the opacity limits of Part 228-1 and the particulate limits in Part 212.4(b) and (c). The Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
