Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0023256) for the surface discharge of treated wastewater to the East Branch of Sandy Creek, a class C water.

The Village of Holley Wastewater Treatment Plant has a design flow of 0.45 mgd. Treatment at the facility consists of an activated sludge process which includes screening and grit removal, extended aeration and secondary settling. Also, treated flow passes through a chlorine tank which is not being used for disinfection at this time. Sludge handling consists of holding tanks and aeration which receive sludge from the final settling basins.The digested sludge is pumped to the sludge drying bed and stored onsite for future disposal of a landfill.

DEC proposes to incorporate the following modifications to this permit: -Administrative updates have been made to the permit. -Phenols, Copper and Cyanides monitoring requirements have been removed from the permit. -Total Dissolved Solids, Maximum Average, monitoring requirement was removed because the sampling frequency is only once per month. -An action level for zinc was added. - A Mercury Minimization Plan was added. - Monitoring requirements were added for Outfall 002. -A requirement to add a sign at Outfall 002 was added. - The Monitoring Locations page was updated.

Project Description:

The applicant proposes to clear woody vegetation from the existing berm to provide access to the Class C tributary ( ONT-117-66-22-8) of Mill Creek in order to remove woody debris blockages and old beaver dam remnants from approximately 300 lineal feet of the stream and restore the flow capacity in the stream that receives discharge water from the Village of Wayland's Wastewater Treatment Plant. The stream and access berm are located within the Class I, State Regulated Freshwater Wetland, WA-6 in the Town of Wayland, Steuben County immediately downstream of the treatment plant.

Project Description:

The Town of Butler proposes to expand its Wager Road Gravel Pit by adding 5.8 acres to the current life of mine (LOM) area. The area to be added consists of 2.2 acres immediately north of the current excavation area, and 3.6 acres immediately south of the current excavation area. The project site is on the east side of Wager Road, within Town of Butler properties totaling 98.5 acres.

All excavation of sand and gravel in the expansion areas will be from above the local water table, and will eventually convert the expanded excavation area to open vegetated land, based on mining plan and reclamation plan contours. Excavation will continue by front end loader and excavator, and will remove up to 6000 tons of material from the site in the next 5 year permit term. Material will continue to be processed on the site by screening. Hours of operation will continue to be Monday through Friday from 7 AM until 4:30 PM with no mining on weekends. No change in truck traffic volume is proposed. Final reclamation will restore the site to open vegetated land. Reclamation will include the replacement of stockpiled topsoil and re‑seeding.

Currently, the life of mine area is listed as 20 acres. Newer, more accurate measurements have shown the permitted LOM area to be 16.6 acres, rather than 20. With the addition of 5.8 acres, the LOM area will increase to 22.4 acres in the next permit term.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
