Project Description:

The New York State Department of Environmental Conservation has prepared a Department Initiated Modification to State Pollution Discharge Elimination System Permit No. NY0029068 for the Limestone Wastewater Treatment Plant, pursuant to 6NYCRR Part 750-1.18 and 750-1.19, the Environmental Benefit Permit Strategy. The proposed changes to the permit are: the relaxing of limits for total suspended solids, the addition of a requirement for a Mercury Minimization Plan for low priority publicly owned treatment works, and addition of a schedule of compliance for assessment and removal of sludge inventory from the wastewater treatment lagoons. The Limestone Wastewater Treatment Plant has an existing design flow of 0.25 Million Gallons Per Day of treated wastewater to Tunungwant Creek.

Project Description:

The Department has received and made a tentative decision to approve an application for a proposed project that consists of the stabilization of approximately 285 feet of the west embankment of Ellicott Creek at Charter Oaks Condominiums on 210 Charter Oaks Drive in the Town of Amherst. The total volume of riprap will be approximately 254 cubic yards and the total area of fill will be approximately 0.08 acres. The applicant proposes to excavate the embankment and cover it with 2 foot thick riprap and 600 dogwood cuttings, and then seeded with native grasses and turf grass. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.

Project Description:

The applicant proposes creation of a Town Park, north of and immediately adjacent to Sturgeon Point Marina. The park will include an asphalt driveway entrance and parking area, wood chip trails, picnic areas, and a Lake Erie overlook gazebo. The project will impact 0.2 acres of federally regulated wetland, 0.2 acre of State Freshwater Wetland AN-7, and 0.44 acre of the State regulated 100-foot-wide adjacent area. Mitigation shall consist of monitoring for and prevention of invasive plant species, along with signage to prevent all terrain vehicle use on the trails.

The applicant proposes to construct a winter boat storage and maintenance facility along the bank of the Niagara River for its tour vessels and to provide amenities for public use and recreational activities. The project would be located approximately 900 feet downstream (north) of the Rainbow Bridge in Niagara Reservation State Park in the City of Niagara Falls, Niagara County. The proposal includes: a seasonal floating dock; a lower boat storage area for the winter dry docking of vessels and storage for floating docks; an upper maintenance area for winter storage of a work boat and maintenance building; a marine lift (crane) and other features.

No further review in accordance with SHPA is required.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
